Man in Tennessee is Seeking Asbestos Compensation

A 94 year old man in Tennessee by the name of Rupert Ellington is seeking asbestos compensation amounting to $2.5 million from his former employer.  Ellington has filed charges with his former employer stating that they have caused him to get sick from asbestos.

Asbestos is a well known carcinogen that causes diseases such as lung cancer, asbestos cancer (mesothelioma), asbestosis, and many other respiratory illnesses.

Ellington claims that his former employer - the Illinois Central Railroad - as well as the BNSF is responsible for illness which he is suffering and claims it is due to asbestos exposure.  Ellington states that while working for his former employer between the years of 1950s to the 1970s, he was exposed to asbestos.

This is not the first asbestos settlement that Ellington has filed for.  In 2007 Ellington sued Illinois Central Railroad and the BNSF suit was added later.

Many railroad workers have been exposed to asbestos in the past since many train surfaces were once covered with asbestos insulation.  This was before it was known that this fiber had a deadly outcome.

Ellington’s case may end up being dismissed since the U.S. District Judge Eduardo Robreno has been known to deny claims of asbestos compensation.  In fact, he has denied 6,000 claims this year.

Since Roberto took over in this position, plaintiffs are required to file a single claim and blanket claims against groups are not allowed anymore.

Asbestos is extremely dangerous since it is a known carcinogen and causes asbestos cancer.  Asbestos was once used in many different building materials such as components for ships as well as roofing, shingles, and ceiling spray inside homes.  Many Americans have worked with asbestos over the years and have been unknowingly exposed. Asbestos is still used today but is regulated by the federal government.
