Asbestos Claim
An asbestos claim is when a person who is unknowingly exposed to asbestos, files charges against a company or other organization for being at fault for their asbestos-related illness. Many people have been exposed to harmful levels of this mineral over the years and have developed mesothelioma due to the negligence of their employers. In the 1970s, asbestos regulations were put in place to reduce the amount of exposure workers faced in the workplace. However, not every company abides by the rules and protects their workers.
An asbestos claim can therefore be filed against the party at fault. People who file asbestos claims tend to be construction workers, demolition workers, manufacturers of asbestos products (i.e. tile, roofing), asbestos removal professionals, or anyone else who has been unlawfully exposed to harmful amounts of this carcinogen while working at their asbestos job.
An asbestos claim can be filed by the person suffering from mesothelioma (or any other asbestos-related complication), or by family member of victims who have passed. The purpose of an asbestos claim is to seek monetary compensation for losses suffered which can help to pay various medical bills, help with lost wages, psychological stress, etc.
Asbestos claims are filed every year in the United States and there have been at least 600,000 filed so far. Since there have been so many asbestos claims, the government has considered starting an asbestos bankruptcy fund. This fund would pay the victims a chunk of money up front if they met certain criteria. It would also disallow them from being able to file an asbestos claim against the party at fault for their illness. Currently the law allows you to file claims against negligent parties.
